Terms and Conditions for Use of Data Lists

General Disclaimer

Fully Stella Solutions LLC (“the Company”) offers a range of data lists to support organizations in outreach and operational efforts. These offerings may include ZIP code lists, prospect lists, and industry directories in nationwide formats or segmented by state or region to meet specific needs.

The Company exercises commercially reasonable efforts to verify and maintain the accuracy of information, including use of professional data-validation partners. However, complete accuracy or completeness cannot be guaranteed. Business closures, mergers, role changes, and other structural shifts can impact data quality. Where direct contact information is not publicly available, the Company may use reasonable inference methods (e.g., common email patterns) to approximate contact details. While applied carefully, inferred data may not be accurate in all cases.

In scenarios involving parent/child or multi-site organizations (e.g., a primary office with multiple satellites), the Company may include contact information only for the “parent” entity where practical limitations make comprehensive child-site data unreliable or not actionable.

The Company does not represent that any list includes every possible record within a given geography or category (e.g., that a state-level list includes every entity operating in that state). Customers should consider these limitations when using the data.

Limitations of Liability

THE DATA LISTS ARE PROVIDED “AS IS.” THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE USE OF THE DATA LISTS.

No Refund Policy

Due to the digital nature of the Data Lists provided by Fully Stella Solutions LLC, all sales are final and non-refundable. Once a Data List has been purchased and delivered, it is deemed consumed. Customers are encouraged to review available information and ask questions prior to purchase to ensure the product meets their needs.

Copyright and Distribution Policy

All Data Lists are protected by applicable intellectual property and copyright laws. Redistribution, resale, sublicensing, or sharing of any Data Lists obtained from Fully Stella Solutions LLC without prior written permission is strictly prohibited. Unauthorized distribution may constitute infringement and is subject to legal remedies.

Use of Company Logo Policy

By agreeing to these terms, the purchasing organization grants Fully Stella Solutions LLC a non-exclusive, royalty-free license to display the organization’s name and logo as a customer reference in marketing materials, on the Company website, and in promotional content. The Company will not modify the organization’s logo without prior written consent. The organization may revoke this permission at any time by providing written notice; the Company will make commercially reasonable efforts to remove references within a reasonable period.

Compliance

Customer is solely responsible for its compliance with all applicable laws and regulations when using the Data Lists, including but not limited to privacy, anti-spam, and telemarketing laws (e.g., CAN-SPAM, TCPA, and Do-Not-Call rules where applicable).

Changes to Terms

By using the Data Lists provided by Fully Stella Solutions LLC, the user agrees to these Terms and Conditions in full. These terms are binding and enforceable under applicable law. The Company reserves the right to update or modify these terms at any time without prior notice. Continued use after changes take effect constitutes acceptance of the revised terms.
